    Judge Refuses Plea Deal in Strangulation, Child Abuse Case

    A judge rejected a plea deal Friday for a 40-year-old man accused of choking and assaulting teenager.
    The prosecutor and the defense attorney came to an agreement in which two felony charges against Henry Matthew Holland Jr. would be dropped in exchange for a guilty plea on one misdemeanor count of assault and battery.
    The agreement would also allow the misdemeanor charge to be dropped without any sentence imposed as long as Holland followed the law for two years.
    After hearing details of the October assault, Retired Substitute Judge Sharon Will rejected the plea bargain citing “the facts of the case” as her reasoning.
    Deputy Commonwealth’s Attorney Cathy Black said Holland took a 13-year-old boy by the throat after he punched his father and slammed him into a wall.
    Holland then threw him onto the kitchen floor and held him there until someone removed his grip on the boy, Black said.
    Williamsburg Police officers responded to the home where the incident occurred in the Strawberry Plains subdivision, but Holland was not at the home.
    The police issued warrants for his arrest, and he turned himself in the next day.
    Holland’s case must now be heard by a different judge, where the same plea agreement may be presented.
    Holland is scheduled for a hearing at 9 a.m. April 10 in Williamsburg-James City County Juvenile and Domestic Relations Court.
